I’ve spent the better part of the last decade building AI systems. For most of that time, I bought into the standard narrative: Indian bureaucracy is a barrier, not an asset. Red tape slows everything down. Regulation stifles innovation.

I was wrong.

As AI governance becomes the defining challenge of the next decade, I’ve come to see something that most people miss: India’s layered regulatory infrastructure isn’t a bug. It’s a feature. And it might be exactly what responsible AI deployment needs.

The Western AI Governance Vacuum

Let’s look at what’s happening elsewhere.

The European Union spent years negotiating the AI Act. It’s comprehensive on paper, but implementation is a mess. Who enforces it? How do existing regulators coordinate? Nobody’s quite sure.

The United States can’t even agree on whether to regulate AI at all. The executive orders come and go with administrations. Congress holds hearings but passes nothing meaningful. The result is a patchwork of state-level initiatives and voluntary industry commitments.

The UK tried a “pro-innovation” approach that delegated AI oversight to existing sectoral regulators - without giving them resources, expertise, or coordination mechanisms. Two years in, it’s unclear who’s responsible for what.

The pattern is clear: countries that need to build AI governance infrastructure from nothing are struggling. Legislation is easy. Implementation is hard. Coordination across agencies is harder still.

What India Already Has

Now look at India’s regulatory landscape.

The Reserve Bank of India has been regulating algorithmic trading and automated financial systems for over a decade. They understand model risk, know how to audit automated decision-making, and have enforcement mechanisms that actually work.

SEBI has rules around algorithmic trading, including requirements for audit trails, kill switches, and testing environments. These rules weren’t designed for AI specifically, but they address the core governance challenges: accountability, transparency, and the ability to stop systems that misbehave.

IRDAI has been grappling with automated underwriting and claims processing. They’ve developed frameworks for explaining automated decisions to customers - the exact capability that AI governance requires.

The Telecom Regulatory Authority has dealt with automated network management and dynamic pricing systems. They understand how to regulate systems that make millions of decisions per second.

This isn’t theoretical capability. These regulators have staff, budgets, enforcement powers, and - crucially - existing relationships with the entities they regulate. They know how to conduct audits, investigate complaints, and impose penalties that actually deter bad behavior.

The Extend-Don’t-Replace Opportunity

Here’s the insight that most AI governance discussions miss: you don’t need new regulators for AI. You need existing regulators with AI expertise.

An AI system that makes lending decisions is still, fundamentally, a lending system. RBI already regulates lending. What they need isn’t replacement by some new “AI Authority” - they need the technical capacity to audit AI-driven lending decisions.

An AI system that recommends medical treatments is still, fundamentally, practicing medicine. The Medical Council already has frameworks for evaluating treatment protocols. What they need is the ability to evaluate AI-generated protocols.

This is the extend-don’t-replace model. It preserves institutional knowledge, leverages existing enforcement mechanisms, and avoids the coordination nightmares that plague new regulatory bodies.

What Extension Actually Looks Like

Let me get concrete. Here’s what RBI extending its capabilities for AI governance could look like:

Model Risk Management Guidelines. RBI already requires banks to manage model risk. Extend these requirements to explicitly cover AI/ML models, with specific requirements for validation, monitoring, and documentation.

Explainability Standards. RBI already requires banks to explain credit decisions to customers. Extend this to require that AI-driven decisions be explainable in terms customers can understand - not technical model cards, but actual explanations.

Audit Protocols. RBI already audits banks. Develop specific protocols for auditing AI systems: testing for bias, validating training data, checking for drift, reviewing decision logs.

Incident Reporting. RBI already requires incident reporting for operational failures. Extend this to cover AI-specific incidents: model failures, unexpected behavior, bias discoveries.

None of this requires new legislation. It requires regulatory capacity-building within existing frameworks.

The DPDP Catalyst

The Digital Personal Data Protection Act is the catalyst this approach needs.

DPDP doesn’t try to regulate AI directly. Instead, it establishes baseline requirements - consent, purpose limitation, data minimization - that any AI system processing personal data must meet. It creates a Data Protection Board with enforcement powers that complement sectoral regulators.

This is smart design. It creates horizontal requirements (data protection) that work alongside vertical requirements (sector-specific rules). AI systems don’t fall through the cracks because they’re novel - they’re caught by both layers.

The Coordination Challenge - And India’s Answer

The obvious objection: won’t this create coordination problems? What happens when an AI system spans multiple sectors? Who’s in charge?

Fair question. But India has solved this before.

Financial conglomerates are regulated by multiple authorities - RBI for banking, SEBI for securities, IRDAI for insurance. The solution wasn’t to create a single mega-regulator. It was to establish coordination mechanisms, information-sharing protocols, and clear rules for lead-regulator designation.

The same approach works for AI. When an AI system touches multiple sectors, designate a lead regulator based on primary use case, with information-sharing obligations to others. This is messier than a single authority, but it’s also more robust - no single point of failure, no single point of capture.

The Real Risk: Not Moving Fast Enough

Here’s what worries me.

India has this structural advantage, but advantages erode if you don’t use them. The window for establishing sensible AI governance is narrow. Once AI systems become deeply embedded in critical infrastructure, retrofitting governance becomes exponentially harder.

The risk isn’t over-regulation. It’s under-action. It’s letting the perfect be the enemy of the good while AI deployment races ahead of oversight.

The sectoral regulators need to move. Not with comprehensive frameworks that take years to develop, but with immediate, practical extensions of existing rules. Guidance documents. Audit protocols. Reporting requirements. The machinery exists - it just needs to be pointed at AI.

What Enterprises Should Do Now

If you’re deploying AI in a regulated sector in India, don’t wait for explicit AI rules. The smart play is to get ahead of regulatory expectations:

Document everything. Training data provenance, model architecture decisions, validation results, deployment configurations. When the audit comes - and it will - you want to be ready.

Build explainability in. Not as an afterthought, but as a core requirement. If you can’t explain a decision, you shouldn’t be making it automatically.

Monitor continuously. Models drift. Data distributions shift. Bias emerges. Continuous monitoring isn’t optional - it’s the minimum bar for responsible deployment.

Engage proactively. Regulators are figuring this out in real-time. The enterprises that engage constructively will help shape sensible rules. The ones that hide will get rules they don’t like.

The Leapfrog Moment

India has leapfrogged before. We skipped landlines for mobile. We skipped branch banking for UPI. We skipped physical IDs for Aadhaar.

AI governance is the next leapfrog opportunity. While other countries debate whether to regulate and build new institutions from scratch, India can extend what it already has.

The bureaucracy everyone complains about? It’s not a barrier. It’s a head start.
